Judge Has Sent Zaidabadi’s Release Order to Jail Three Times

By IHRV | November 21, 2009

untitled.jpgA few days after the assignment of a release bond for Ahmad Zaidabadi, the activist is still being held in Evin Prison.

According to Mehdieh Mohammadi, the wife of Mr. Zaidabadi, a judge in branch 26 of the Revolutionary Court, identified as Pirabasi, told her that in reference to Mr. Zaidabadi’s release, he has already sent three release orders to prison authorities.

Ms. Mohammadi said: “Branch 26 told Mr. Zaidabadi’s lawyer and myself that he has already sent three release orders to prison authorities, but those authorities have refused to carry out the order.  I want to know who or what within the prison allows itself to disobey a judge’s order and obstruct with my husband’s release?

Who are these people, sidestepping the law so readily?  When did the Prison get such authority?”

Ms. Mohammadi added: “The judge assigned to the case has made variety of statements since last week:

On Sunday of last week, they [the court] told us to arrange for a release bond.
On Monday, when we took a bond-related document to the court, we were told to hold on for the time being.
On Tuesday, they [the court] told us, ‘we apologize, hold on until tomorrow’.
On Wednesday, they [the court] said they had not received release document yet.
On Saturday, the court said they had received release order, which would be sent today.

The judge in this case is either powerless or a weak man, acting in such a manner.”
